This page is intended to serve as a document repository for information related to Springwood Lakeside Individual Property Owner's Association. Information was gathered via multiple sources, including but not limited to, Registrar of Deed's Office, State and County agencies, Neighbors and responses from HOA leadership.
This page will also link to, and provide information about the requirements for HOAs in South Carolina and Richland County.
Is it Illegal to Post copies of official HOA documents we have received as a homeowner, to a public web site providing information about the HOA?
No, it is generally not illegal for a homeowner to post copies of official HOA governing documents (such as the Declaration of Covenants, Conditions & Restrictions (CC&Rs), bylaws, articles of incorporation, or rules) on a public website, especially when the purpose is to provide information about the HOA. Here’s why, based on how these documents typically work in the US:
- CC&Rs (and often related declarations) are recorded public documents filed with the county recorder’s office to bind the property and run with the land. They are public records by design—anyone (not just homeowners) can obtain copies from public records, and many real estate professionals, buyers, and researchers do exactly that. Posting them doesn’t make non-public information suddenly public; it’s already public.
- Many states treat core governing documents (especially recorded ones like CC&Rs) as public or quasi-public in nature. In states like California, Florida, Texas, and others, laws either require HOAs to make these documents available or treat them as accessible records. Some states (e.g., Florida for larger HOAs, Texas under certain conditions) even mandate that HOAs post governing documents on their own websites.
- Copyright concerns are usually minimal or nonexistent here. Governing documents like CC&Rs and bylaws are typically functional/legal texts created for a specific community, not highly creative works eligible for strong copyright protection. Even if some portions were copyrighted (unlikely for standard templates), posting the full document for purposes like commentary, criticism, education, or transparency about the HOA would very likely qualify as fair use under U.S. copyright law (17 U.S.C. § 107), especially if it’s non-commercial and transformative in context (e.g., highlighting issues or informing the public).
